Board of Adjustment

The Board of Adjustment hears and decides appeals where it is alleged there is an error in any order, requirement, decision, or determination made by the Building Inspector in the enforcement of this Chapter, and may affirm or reverse, in whole or part, said decision of the enforcement officer.  The Board of Adjustment hears requests for variances from the literal provisions of the Zoning Ordinance in instances where strict enforcement of the Zoning Ordinance would cause undue hardship due to circumstances unique to the individual property under consideration and grant such variances only when it is demonstrated that such action will be in keeping with the spirit and intent of the provisions of the Zoning Ordinance.

Meetings

Meetings are held at the call of the chairman of the Board of Adjustment and at such other times as the Board may determine.

Agendas & Minutes

Agendas are available prior to meetings.  All meeting agendas are posted no later than 24 hours prior to the meeting.  Minutes are available following approval.

Members

The Board of Adjustment consists of five members appointed by the Mayor and approved by the Board of Aldermen.  Members are appointed to serve five year terms.

Qualifications

Members of the Board of Adjustment shall be residents of the City of Rock Port.
